General Terms and Conditions (“GTC”) of Claudia Scheffler-Perrone and Killer Press. Applies to both Killer Press workshops and the use of videos, audios, and more: Scope: These GTCs apply to the attendance and participation in events (seminars, workshops, events, etc.) organized by Killer Press and the use of provided videos, audios, and other materials. Any deviating agreements require written form. By registering for an event or using the provided materials, the customer agrees to these GTCs. If any provisions of these GTCs contradict mandatory legal regulations, the remaining provisions of these GTCs shall still remain valid. Killer Press or Claudia Scheffler-Perrone reserves the right to change the content of their services at any time. If the client has booked a coaching session with the coach/trainer after the last initial consultation, the client initially agrees to be coached according to the procedures discussed at the last initial consultation. Once the client has arranged a written appointment for coaching with the coach/trainer, the coach sends the client a booking confirmation, which can be revoked within 14 days. The subjectively expected success of the coaching or training cannot and will not be promised or guaranteed. Therefore, the subject of the service contract is only the provision of the agreed coaching or training services, not the guarantee of achieving certain goals desired or expected by the client. If the client rejects the conversations, methods, measures, or other approaches proposed by the coach/trainer, the coach may suspend the coaching without further explanation. Coaching and training are explicitly not medical practices and therefore the coach/trainer may not diagnose, treat, or alleviate diseases as defined in HPG § 1 paragraph 2. Instructors/trainers may also not call in sick or prescribe medication. Documents provided during coachings, trainings, or workshops are created by coaches/trainers based on their knowledge and expertise. Liability and guarantees for the accuracy, timeliness, completeness, and quality of the contents are generally excluded.
Registration: The contract for participation in one of the offered events is concluded by the acceptance of the customer’s registration by Killer Press. If a registration cannot be accepted, the customer will be notified immediately. Registrations are considered in the order of their arrival, subject to availability. Each registration is binding. With the online registration, registration by email or phone, a seminar place is reserved for you.
Payment: The amount of the event fee can be found in the event description. All prices are plus statutory VAT. The currently valid GTCs for seminars and workshops apply. The event fee is to be transferred to the organizer’s account 4 weeks before the start of the event. The participant will receive an invoice in advance. If the seminar fee has not been received by this date, the organizer has the right to exclude the participant from the event without further reasons in writing or by telephone (e.g., email) for 10 working days (counted from the 4th week before the seminar).
Cancellation: Cancellation or rebooking (rebooking to another course or a different date) on your part, received in writing at least 30 days before the start of the seminar, is free of charge. For cancellations on your part received less than 30 days before the start of the seminar, 50% of the course fee is due. For short-term cancellations or rebookings (less than 10 working days before the start of the course) or for non-attendance at the seminar (no show), 100% of the course fees are due. Rebooking and cancellation require written form in any case and only become legally valid through our confirmation. Rebooking to a substitute participant is possible at any time free of charge.
Copyright: All provided documents, videos, and audios are copyrighted. I always explicitly point out that the videos are for demonstration purposes only and must be replaced by links if one of the presentations is used. Failure to comply will result in any liability for copyright infringements being excluded and the user bearing sole responsibility. All rights, including reproduction, reprinting, and translation, remain with Killer Press – Claudia Scheffler-Perrone. Any use in any form without written permission is prohibited.
Liability: In case of cancellation of a seminar due to illness of the lecturer, insufficient number of participants, or events beyond our control or force majeure, there is no claim to the execution of the seminar. We accept no liability for items brought into the workshops and training events or for any other direct damages and costs, including loss of earnings, lost profit, or third-party claims, data loss, travel expenses, consequential and property damage of any kind. Changes: In exceptional cases, changes (e.g., changes to the event location) may become necessary, which we will inform you of immediately.
Data Protection and Image Rights: The personal data of a registered participant for an advertised seminar will be stored by the organizer within the framework of federal data protection. The organizer ensures confidential treatment of these personal data. The image and sound materials possibly recorded at an event may be used for self-promotion purposes on the organizer’s website and on image and sound carriers in any form without further inquiries. Further use, especially commercial exploitation of the recordings, is excluded. Exceptions are clarified separately and granted in individual cases after the consent of the respective participant and the organizer in writing. Should individual provisions of this document be ineffective, this does not justify the ineffectiveness of the remaining provisions of the general terms and conditions. Side agreements and special agreements with a participant are only legally binding if they are made in writing or confirmed in writing by the organizer. The use of possibly provided videos or audios for your own advertising purposes, especially on the customer’s website, requires prior written consent from Killer Press – Claudia Scheffler-Perrone. Responsibility for Legal and Data Protection Violations: The user of the materials provided by Killer Press or Claudia Scheffler-Perrone (including but not limited to videos, audios, and written documents) bears sole responsibility for complying with all relevant legal provisions and data protection guidelines. Should the use or distribution of these materials lead to violations of applicable law or data protection regulations, the responsibility lies exclusively with the user. Killer Press and Claudia Scheffler-Perrone assume no liability and are to be indemnified from any third-party claims.
Severability Clause: Should individual provisions of the consulting contract or the General Terms and Conditions be or become invalid or void, this does not affect the validity of the consulting contract as a whole. The invalid or void provision shall be replaced by a provision that comes closest to the purpose of the contract or the parties’ intentions in a free interpretation.
